Sierra Sam wrote:Like Jim states, it has always been my understanding that it was only when the New 49ers basically, openly, thumbed their noses at the Klamath natives (operative word here is "native"), ignoring their concerns with respect to their fishing rights and conservation efforts to support a renewable resource of salmon in the area, that the "stuff" hit the fan, so to speak. They openly voiced their stance that they were not against "miners", that their concern was that of their fishing industry on a relatively small section of river in a specific area and that those rights as defined by the United States Government for indigenous tribes, were being ignored.

My take was that the New 49ers were more focused on their margin than the sport, hobby and business of mining. I know from personal experience that fish begin to suffocate if the water becomes too murky and feel guilty if I see fish begin to roll on their sides from lack of oxygen.

Sam, you need to read what I wrote again. I never stated anything like what you wrote. Your understanding, as you wrote it is totally flawed. The club never thumbed it's nose at anything native. We went out of our way to address the natives concerns about their sacred areas. Dave Mack instantly shut down any of our claims that the natives said were in sensitive areas.

I don't know what enviro-wacko literature you have been reading, but murky water has absolutely nothing to do with fish suffocating from lack of oxygen. If murky water killed fish, they would all die in the winter runoff. Your so-called "personal experience" is a farce. I defy you to prove that anyone has ever seen fish rolling over and dying from turbid water.

I lived in Alaska for thirty seven years and every year when the glacier melt is happening, the water is so thick with sediment that you cannot even see the salmon when their dorsal fins can be seen poking through the surface. They thrive just fine.

You sound more like an enviromentalist than a miner.

One last thing. You wrote about the indians rights being ignored. This shows your total ignorance on this issue. The Karuk Tribe has no reservation, therefore, by law, they have no fishing rights.

 The insideous anti mining cancer from the klamath has poisoned the well from whence all our rights came. Throw in PLOP ignorance and viola NO DREDGING RIGHTS. Watched the train wreck worsen for over 25+ years whilst 99% did nuttn' but say the GPAAAA,Plop and the 69rs are using our cash to protect us  NO NOT just feathering that nest. For a snipet... www.northcoastjournal.com/0830007/cover0830.html . Public perception has absolutely been proven to be 90+% of the anti dredge mining problems. Try living down EPA headlines in the media-MERCURY DUMPING IN HAPPY CAMP CLOSES TOWN AND HIGHWAY. Superfund cleanup site, indian ceremonies stopped by dredgers and 100s a incidents blown up into media . Miners massive land grab on the Klamath requires Congress and the DOA to rewrite claim laws blah blah blah as 49rs stage mass exodus into Oregon rivers as advertised on the web and massive land grab forces Governor of Oregon to appeal to the federal government for injunctive relief on and on and on and on-year after year all we hold dear slaughted by the greedy few.... salmon are funny fish, i must get a stamp to fish for them, in the Ohio river. well any river in my state, most of them i have never ever seen the bottom of the river. yes there are tons of salmon in the river. if you know what time of year you can see some of them run.
i caught some on accident in a stream. took me a bit to figure out what the heck i had, the main reason was well not many here fish for salmon. every time i hear about the turbidity laws going in to effect, i must wonder whats going on.

I totally agree with you Bob4au
I think we need to make the indians citizens of the United States of America and give them exactly what I get!! I pay out the A$$ to even fish or hunt in Oregon anymore. I just can't afford to buy a license to kill fish, wildlife or upland game birds. Now I can't afford to buy a license to look for gold.

Most of the treaties gives them sovereign rights. Are you saying we should break the treaties and declare war on them?
Sounds just a little nuts to me. You can't make treaties with nations (no matter how small) and then break them willy-nilly.
That is what is going on with the Government and the greenies right now they are circumventing the laws (with lies and faulty science) to stop mining are you really saying we should join the greenies?
Lets give a little more thought to the "solutions" that you post, because solutions they are NOT, and only give them ammunition to use against us.

I am saying that the treaties have out lived the intent. Like slaves, times have changed. Why does the goverment contiue to discrimanate for Indians!
I spent many years fishing out of Neah Bay Washington, the home of the Makah reservation. Did you know that the tribe gives out housing, food, clothes, furniture, everything needed to live on the res. The only thing that they buy is cars, smokes and booze. They dont even pay taxes on the gas they buy. They dont pay any taxes! What incentive would you have with everything provided to you? They have fishing and tourist to make money. Every family has a commercial fishing boat with a current permit from the state. Many of these boat have not been in the water for years. The family gets gov. dollars NOT TO FISH. Like farmers get money not to farm.
I think that treaties have out lived the intent. Like slavery and discrimination !
I believe that OUR goverment needs to use some COMMON SENSE !
ALL MAN CREATED EQUAL UNDER THE CONSTITUTION OF THE UNITED STATES !
I could ramble on and tell stories that would make you mad or sick or both!
Did you know the beaches on the res. has good gold and other metals. But non tribal members are not allowed to remove anything from the beach. not a rock, sea shell or a piece of drift wood. and they dont prospect or mine anything!
I could go on with stories that would make you mad or sick or both!!!!

Most treaties do not have expiration dates. If you want to change a treaty you have to negotiate a new one, but both parties have to agree to want to change it in the first place. Many of the treaties with the native's of this country give them sovereign rights they are not US citizens as you think they are.
That is why the constitution does not apply to them as it does to you, the treaties made sure of that. They are sovereign nations that cooperate on a certain level with the United States.
The history of this country is that every-time the US wanted to grab something they thought they should be able to have they crapped on the natives so there is not a lot of wiggle room on our part. And I for one sure wouldn't agree to change anything If I had a treaty that guarantied me rights,-that would be totally stupid. The treaties stand and we have to live with them.
You should be more worried about treaties that the O'Bummer administration is negotiating right now that the folks will have to live with, than worrying about something that can't be changed.
The treaties were negotiated a long time ago and the will most likely be there for as long as the USA exists.
By the way bringing up slaves is not a good comparing, the way slavery ended was through war. The treaties are legal they (many) have been challenged all the way to the supreme court, they stand the decision is final.
So you have four options, one renegotiate the existing treaties (wont happen) two file a law suit and take it through all the courts till you and up at the supreme court, (you will loose) three go to war, (taint gonna happen) four live with it and get over it, (I would suggest this option)

Besides to suggest that the problems that miners,- small and large face in this country is caused by a few treaties with the native of this country and would solve the problems "If we could only change the treaties" is not rational.

If you favor the protection of the treaties....FINE...you got it!

Every single treaty states there shall be no alcohol allowed inside the borders of the reservation. Time for some hard-line enforcement of the "agreed treaties"....sucks for the casino but hell, we just gotta stand up to that treaty, right?
While you are at it lets just take that sovereign nation horse shit to its fullest logical extent. If Two Dogs wants to drive to a Walmart then he will need to bring his passport and then pay tax...oh, and they should probably make plans to provide their own 911 services on the rez because we wont be "crossing the border" with the firetrucks and ambulances anymore.

The simple fact that no one wants to discuss is that the treaties were written before tribal casinos existed. This has had a huge and terrible impact on their culture. The treaties are obsolete and are being rampantly abused by inconsistent enforcement. Allowing the treaties, reservations and federal subsidies to continue is destroying every shred of original Indian culture that remains. At one time their culture was based on land stewardship, worship and family but now it is mostly replaced with what we consider to be a vice....gambling, alcohol, tobacco.

Declare war on the tribes? We already did and they lost. No amount of handouts or liberal guilt will change that.
