Questioning by Forest Service Special Agent?

Postby Ron_L » Thu Apr 01, 2010 5:48 pm

Not related to mining, but took place on a mining trip last July, some friends found a skull and didn't turn it in "right away"!
I told them to call the sherrif or somebody, anybody - just call!!!
Turned out to be a native American - there's where the trouble begins!
Since I saw it, I've been contacted by a Law Enforcement and Investigations Special Agent (Forrest Service) who has been asking lots of questions...
I was nice and answered her questions months ago, but received a call tonight wanting more personal info from me...
Full Name, Date of Birth, Address and my Drivers License Number

I absolutely refused to give my Drivers License Number

Wouldn't you suppose that any questioning would be a violation of Miranda if not given? (And it was not)
I feel that was denial of due process under both the Fifth and Fourteenth Amendments, and an example outrageous government behavior.

Any thoughts guys?
Time to lawyer up and consider a civil suit?

When i lived in S.E Alaska one of the fisherman found a very large Tlingt tribe war canoe stuffed in the willows. it was probably a man killer because of its unusually large size (near 60 ft) and the reason it got beached ... well he was tellin the story one nite in the waterin hole and a forest circus clown more that likely over heard him. they harassed him for months to reveal its location and even threatened him with arrest, but he stood strong and told them to go "trim some trees" ( a polite recounting of said conversation). So when it comes to artifacts dont touch, dont tell and maybe a thin coating of the sands of time will help erase your recollection
all we're lookin for is locatable valuable minerals

 GREAT saying Russau :D , Special agents only deal with violations of the archology(sp) and antiquities act :? Please practice the following--I AIN'T SEEN NOTHING--I AIN'T FOUND NOTHING--AND I DON'T KNOW A DAMN THANG!!!! Your life will be easier--just go to a payphone, check parking lot for security cameras that record you and auto LP #, and call it in and your free after wiping off the receiver--John

And sometimes doing the right thing can save you allot grief later. I found a abounded car out in the desert during the summer months. Many things about it, just didn't look right. So I called the Sheriff and assisted him in searching the area with negative results. About 4 months later while riding my atv a short distance from where I found the car, I found the body of the driver. Not something I wanted to see, but I was very glad I did the right thing months earlier.
