Got the Results Today

After waiting nearly three years for the appeals court to review my case for dredging on the Rogue River I received the court report today. They affirmed my conviction and sentence. I had to pay the fine immediately, 1650.00 and three years probation. The good news is that I'll be off probation in April 2016. I'm really disgusted that the appeals court still believes that you need a permit to pollute even though Supreme Court Justice Sandra Day O'Conner ruled that dredging was NOT polluting. What can I say except this is Oregon! They're following in the footsteps of California trying to force a mining moratorium on Oregonians for a period of 5 years with a possible extension. PLEASE support any and all groups who are fighting to keep us in the water.

New 49ers is in the lead along with Waldo Mining District suing to keep us mining.

Randy im really sorry to hear this! I hope your appealing this decision to a higher court! It seems these "courts" are just doing a "monkey see , monkey do" approach!

According to the letter, I have the option of appealing the decision to the Oregon Supreme Court but it sounds like the Oregon Supreme Court is not required to review my case. quote>Generally, the Supreme Court allows review of very few cases and reviews only those Court of Appeals' decisions that involve matters of significant public or legal interest or conflict with previous Court of Appeals or Supreme Court decisions <end quote. I'll be off probation in March or April. Then I'm going to challenge the USFS to prove that they can stop all forms of prospecting in a "wild and Scenic Corridor" because of the "withdrawn from mineral entry" they believe gives them the right to close all prospecting.
I went to the Gold Beach Ranger District and handed head ranger Tina Lanier ORS 517.120 PARAGRAPH 4 and she said it was how I interpret it. Soooo I'm going to see how the law interprets it.

Withdrawn from mineral entry is usually used to deny the right to claim by the Bureau Of Reclamation under Power Withdrawl. They have used, the FS, it to force a POO on the Merced also as Wild and scenic bs also. But to completely deny a right to mine at all? In a Wilderness classification it only works for gas engines of all ilk. Bummer for sure-John

Judge says no way Calif, cant deny permits, here we sit :x

Bastages....

We need to have dredges put on the endangered species list, they are soon to be extinct.

our socalled "representatives" don't have the backbone to go up against the wacoenviromentalists OR have their lifeline ($$$$$$$$$$$$$) threatened to get cut off if they don't follow orders! and who says "crime and corruption don't pay"!!!!
