Claim Jumpers

Postby DJR » Wed Aug 03, 2016 1:18 pm

Does any one know how to go about filing a complaint against a group of miners, that tore down my claim sign and monument and started mining my claim.
Where should I start?
Sheriff, BLM, State, National Forrest people?
Any one know a Lawyer that handles this kind of problem in CA.

These people came in and started digging huge holes on my claim and mining it, they also dumped a bunch of stone in to the creek and dug big holes in to the bank.
Now they think it's going to go away by ignoring me, this will not happen.
Any info would be appreciated

Unfortunately, the sheriff probably wont do much unless you really lean on them and have some idea of who "they" are
National forest, that would be national forest peoples (forest circus), same story, under manned, under funded
If its a well used area, all you will hear is "we will patrol it" meaning they may drive by once every other day maybe
Never see them boys on weekends
No need for lawyers yet
Maybe try some game cams, although they could become enticing targets
You need some sort of ID, license plate, picture of these critters

Huge holes, did they bring in heavy equipments ?
County folks would like to hear of heavy equipment use without proper permits

In some areas that elect the Sheriff you can get help from them, trinity is a perfect example as you have "Felony mineral trespass" and Shasta Sheriff also helps. Your BLM/FS are required by law to assist or even the law of Citizens arrest works also but I lost a perfectly good KG 99 that way as there was action back and forth. I won in court but have a video and witness with you and your golden. 1 question-paperwork must be in 100% compliance, jus' sayn' ducks in a row before you go. BLM/FS is your best bet, then sheriff, the citizen arrest or restraining order/cease and desist orders work and sue them in small claims so no big bill to nasty liers, lawyers.John PS removal of your claim signs is also yet another felony too

Ph I know who they are, they left their claim sign with all the info on it on my claim. and even came back to fill some of the damage.
But they seem to think they can walk off with my gold without compensating me, that will not happen.
Thanks for the info, I'll get started by calling the ElDorado Sherrif and see what they say.
If anyone else has info please let me know.
Huge holes" I mean comparatively.

I'm no lia ahhh lawyer, but a "sign" that someone left behind isint an ID of the critters.
The sign could have been left there by anyone.

If you do make contact with law enforcement, let us know what they said and maybe will do
If any of the others have this same issue, we have a better idea of what to do or say.
If this is on Dogtown, I have seen signs of dredging
The only LE I have seen in the area, is fish and game looking for poachers
Which I guess is what is happening to you in a way
Next thing your claim will be on EBay for sale

Damn John,
With that weapon, they'd thought you a terrorist or something
