EPA & Army Corps Seek to Expand Clean Water Act

On May 2, 2011 The Environmental Protection Agency (EPA) and Army Corps of Engineers (Corps) (collectively the “Agencies”) proposed draft Guidance that would expand the Agencies’ Clean Water Act (CWA) regulatory authority over more land. In addition, the Agencies are seeking to implement this Guidance without formal input from farmers and ranchers, and other impacted groups.The proposed Guidance would be used by the EPA and the Corps to reinterpret the term, “waters of the United States.” This is unnecessary and would inappropriately make more farm and ranch land subject to costly and burdensome Clean Water Act permitting and restrictions.
The Agencies have also indicated that this increased regulation will affect the implementation of all programs authorized under the Clean Water Act, including the NPDES permit program.
Take action today
to encourage the EPA and Corps not to implement the Guidance document. Comments are due by Friday July 1, 2011.
