Mo. residents upset by order to move lake homes

AMDENTON, Mo. (AP) — Nearly every year, Patsy Riley has gotten unsolicited offers for her house on Missouri's Lake of the Ozarks with its spectacular views of tree-lined bluffs and its ample shoreline, but she never wanted to leave. Now, she and hundreds of her neighbors wonder what will become of their homes after a federal agency declared that many structures built close to the lake may have to go.
The Federal Energy Regulatory Commission, citing restrictions on private developments around dams, says thousands of residences, decks, patios and boathouses appear to encroach on land belonging to the hydroelectric project in violation of federal regulations.
The announcement has triggered panic in the area's lakefront communities and led to a growing battle among regulators, a utility company, land attorneys and the state's congressional delegation. Officials say they are searching for a way to settle the issue without mass evictions.

The Federal Energy Regulatory Commission, might this be one of Obummers creations. I'll bet that the homes were sited with the high water mark in mind and thus pose on hazard to the lake on the residents. Just another case of a gubment agency over stepping it's charter.

i read about this in our paper. i have several friends that have homes around the lake. these propertys sold like hotcakes.this is very exspensive property. Rep. Vicky Hartzler (R) is fighting back and meeting with the effected landowners. she also propsed a House bill 3244 to reduce this authuritys power. but i could see a lot of realitors, tiile survey companys being sued for not devulging this info initially! in missouri its called a "diclosure law"the current owner is required by law to put all defects/legal problems in writing to inform all of any current or previous problems with the land or structure to the potential buyers of the land. many of these homes have been there for many years, why now does this comeup???????? depending on the outcome of this, some socalled "representatives" of ours may not be back in office!

If the property was sold before this commission can into existence there wouldn't have been anything to disclose. If the commission existed but didn't have the rules on the books that they have now, again there would have been nothing to disclose. They might be making rules and trying to enforce them when in fact the land owners rights predate those rules.

The land owners need to get together a good legal and legislative team and put the full squeeze on the commissions stones, aka family jewels, aka balls. If they start up a legal assistance fund I'll plunk in a few bucks. Russ you're pretty close to that area, right, keep us tuned in and if they start a fund.

i agree Gramps,but a lot of these homes resold over the years and they would be required to disclose these facts.your dorrect,the original owners wouldnt! the Lake of the Ozarks is about 250 miles from me,and this info will hit the papers and ill post info about the results.

Here in Northern kalif the Forest circus has doubled,tripled and quadripled the prices of leases of homes and 10X for resorts,which are near bankruptcy(2 filed for it this year) as the government moves against it's citizens-legal or not they're doing it and don't seem to give a tinkers damn??? Would appreciate updates as any/all process/procedures utilized just might be applicable to some kalif problems too-thanx much for the insight into the plight-KUDOS jOHN

the papers have been going back and forth about lawsuits on this, but todays paper had that the Federal Energy regulatory commission said that any homeowner with a valid "deed,or lease, or easement" would not have to remove any structure, even if it lies in the project boundry. for any other without documentaion, the Agency encouraged Amerron to work with residents to redraw the boundries to exclude their property. my take on this is that there would be mountains of paperwork from the MANY lawsuits against RE companys/title survey companys and tiitle insurance and so on! why did the Ameron wait so long to stop/prevent these people from buying/building on this land. sounds like someone was asleep or screwed up big time and now Ameron has to pay the piper!.

Also smells like some of the stuff they have done with my property by enacting set back laws
that make the property acquired by me over 50 years unbuildable. It falls under the area of
the taking of property without just compensation by the government, or in this case the
County Government. But the problem is having enough money to pay the legal fees to
fight back. Seems to me the grandfather laws should also provided some protection when the
subdivision was approved prior to enacting laws 50 years later.
